These Terms of Use apply to your access to and use of the Restore Delivered website at restoredelivered.com (the "Site") and any materials, information, products or services (the "Services") provided through it by or on behalf of Restore Hyper Wellness and our owners and affiliates (collectively "Company," "we," "us" or "our"), or by third parties we contract with.

By accessing or using the Site you agree to these Terms of Use, as updated from time to time. Please read them carefully. If you do not agree to be bound by them, do not access or use the Site or Services.

Privacy

Our Privacy Policy and California Privacy Notice form part of these Terms of Use and are incorporated by reference. By accepting these Terms of Use you agree to our collection, use and disclosure of information as described there, as updated from time to time.

Not Medical Advice

The contents of the Site and Services are for informational purposes only and are intended to help you understand your health. They are not a substitute for professional medical advice, diagnosis or treatment.

Always seek the advice of your physician or another qualified health provider with any questions you may have about a medical condition, and before starting or changing any treatment.

We do not recommend or endorse any specific medication, product, course of treatment, provider or pharmacy that may be referenced on the Site. Reliance on any information provided by us, our employees or third parties is solely at your own risk. Never disregard or delay professional medical advice because of something you read here.

Our Services

Services offered through the Site are not health insurance and are not a substitute for health insurance. By ordering through restoredelivered.com you agree not to submit claims for telemedicine services provided to Medicare, any other federal payor, or any state or private payor.

While we work with preferred pharmacies, you may direct your prescription to the pharmacy of your choosing. Email support@restoredelivered.com before completing your order if you would like to use your own pharmacy.

There is no guarantee that you will be treated by a provider or issued a prescription. Whether care or a specific treatment is appropriate is determined by a board-certified provider in their professional judgment, and a provider may decline care for potential misuse of services or where treatment is not medically or ethically appropriate. Local RN support and in-studio services are for education, accountability and wellness only and do not constitute medical clearance.

Use of the Site

The Site and Services are intended for personal, non-commercial use only, and use is voluntary. You are responsible for all phone and data charges you incur.

We may disable the Site or any feature, or make it available to anyone, at any time and for any reason without notice or liability. On termination or cancellation, your right to participate in the Services ends immediately and you must stop using the Site. Provisions intended by their nature to survive will survive termination.

Some Services are provided by third parties, including prescriptions filled by participating pharmacies. We do not guarantee the quality of services or products offered by any third party.

Electronic Communications

When you use the Site or send us a text or email, you are communicating with us electronically. By using the Services you consent to receive communications from us electronically, including SMS or text messages, email and notices posted on the Site. SMS consent is not shared with third-party providers. Text and email are not fully secure methods of communication and there is some risk that a message could be read by an unauthorized third party. You agree that electronic communications satisfy any legal requirement that a communication be in writing. Message and data rates may apply; reply STOP to opt out of texts.

Intellectual Property

All content included in or made available through the Site — text, graphics, logos, designs, data, icons, images, audio, downloads, compilations, technical data, documentation, know-how and software — is the property of the Company or its suppliers and is protected by United States and international copyright, trademark and other intellectual property laws.

All custom graphics, icons, logos, design marks and service names are trademarks or service marks of Restore Hyper Wellness and its owners. All other marks belong to their respective owners. Nothing in these Terms of Use grants you any right to use any trademark, logo or name of Restore Hyper Wellness.

Minors and Use as a Legal Guardian

You must be 18 years of age or older to access or use the Site. By using the Site you represent that you are 18 or older. If you use the Site as the parent or legal guardian of a minor, you are fully responsible for complying with these Terms of Use.

Your Conduct

You agree to comply with all laws and regulations applicable to your use of the Site. When using the Site you agree to:

  • Not interfere with the proper working of the Site or compromise its security.
  • Not solicit illegal activity or activity that infringes our rights or the rights of others.
  • Not attempt to gain unauthorized access to any part of the Site, our servers or connected networks, including by hacking or password mining.
  • Not probe, scan or test the vulnerability of the Site or any connected network.
  • Not attempt to breach security or bypass authentication measures.
  • Not upload or transmit viruses or code designed to disrupt or damage software, hardware or telecommunications equipment.
  • Not use the Site to reveal information other than your own, or that of a person whose care you are legally authorized to manage.
  • Not use robots, spiders, scrapers or other automated means to access or collect content without our permission.
  • Provide accurate, current information, keep it updated and not impersonate anyone.
  • Be financially responsible for all use of the Site.

We may terminate your access at any time, at our sole discretion and without prior notice, for violating any of the above.

Marketing and Opt-Out

By using the Site you agree that we may market our services and those of other companies through banners, links and similar devices. Products offered are at our sole discretion and may come from companies not affiliated with us. Non-affiliated companies are solely responsible for the services or products they provide, and we do not endorse or guarantee them.

You may opt out of marketing emails at any time using the unsubscribe link or by contacting support@restoredelivered.com. You may still receive non-promotional messages about your account, services you requested or important administrative, technical or safety notices.

Accuracy of Information

We aim to be accurate in the information and Services we provide. Despite our efforts, content on the Site may occasionally be inaccurate, incomplete or out of date. If a price referenced on the Site is not as described, your sole remedy is to accept the corrected price or forgo the transaction.

We make no representation as to the completeness, accuracy or currency of any information on the Site. We have no duty to update it, and your reliance on it is at your own risk.

Security and Safety

We use reasonable measures to protect the Site and the information transmitted through it, but no system is completely secure. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

Disclaimer of Warranties

The Site and Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure or error-free, or that defects will be corrected.

Limitations of Liability

To the fullest extent permitted by law, the Company and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill, arising from or related to your use of the Site or Services, whether based in contract, tort, strict liability or otherwise, even if advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

Indemnification

You agree to defend, indemnify and hold harmless the Company and its affiliates, officers, directors, employees and agents from any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site or Services, your violation of these Terms of Use or your violation of any rights of a third party.

Dispute Resolution

Any dispute arising out of or relating to these Terms of Use, the Site or the Services will be resolved through binding individual arbitration rather than in court, except that either party may bring a claim in small-claims court. You and the Company waive the right to a jury trial and to participate in a class or representative action. If any part of this section is found unenforceable, the remainder will continue to apply.

Changes to These Terms of Use

We may revise these Terms of Use at any time. Revisions take effect immediately upon posting unless we state otherwise, and the "Last updated" date above will change. Please review this page periodically. Continued use of the Site means you accept the revised terms.

Access or Use Outside the United States

The Site is controlled and operated from the United States and is intended for United States residents. We make no representation that the Site or Services are appropriate or available elsewhere. If you access the Site from outside the United States, you do so at your own initiative and are responsible for compliance with local law.

Governing Law

These Terms of Use are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to the Dispute Resolution section, you consent to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.

Severability, Entire Agreement and Operation of the Site

If any provision of these Terms of Use is held invalid or unenforceable, the remaining provisions remain in full force. These Terms of Use, together with the Privacy Policy and any posted rules for particular Services, constitute the entire agreement between you and us regarding the Site. The Site is operated by or on behalf of Restore Hyper Wellness from its offices in the United States. Our failure to enforce any provision is not a waiver of it.

Digital Millennium Copyright Act (DMCA) Notice

If you believe material on the Site infringes your copyright, send a written notice to support@restoredelivered.com including: identification of the copyrighted work, identification of the material and its location on the Site, your contact information, a statement of good-faith belief that the use is unauthorized, a statement that the notice is accurate, and your physical or electronic signature under penalty of perjury.
